Terms and Conditions

Last updated: 15 October 2026

1. About these Terms

These Terms and Conditions apply to all services provided by Omniconverse ("we", "us", "our") (registered as OMNICONVERSE, business number 2026 / 744228 / 07) to you ("you", "the client"), including through our website and booking page. By accepting a proposal, paying an invoice or using our services, you agree to these Terms. If you do not agree, please do not use our services.

2. Our services and plans

We provide websites and marketing systems for home service businesses. We offer three plans:

  • Get Found (Online Presence): a professional, mobile-friendly website, WhatsApp and click-to-call buttons, a quote request form, domain registration and renewal, and website hosting, SSL and basic technical maintenance. Website updates are quoted separately.
  • Respond to Leads (Lead Management): everything in Get Found, plus a lead pipeline and shared inbox, automated enquiry acknowledgement, missed-call text-back, automated review requests, Google Business Profile setup and basic management, monthly local SEO maintenance, business email for up to 5 team members, a business phone number, one customer re-engagement SMS campaign per month, a monthly system health check and performance summary, up to 2 hours of website content changes per month, and priority support.
  • Grow: everything in Respond to Leads, plus ongoing marketing work such as social media management, email marketing and full Google Business Profile management, with the scope agreed in a written proposal.

The plan you choose, and anything specific to your business, is set out in your proposal or order confirmation ("the Order"). If there is a conflict, the Order prevails over these Terms.

3. Fees and payment

  • Get Found: R4,999 once-off, payable either in full before work begins, or as a R2,500 deposit before work begins and R2,500 once the site is done, plus R899 per month for domain, hosting and maintenance, with monthly billing starting on the launch date.
  • Respond to Leads: R3,499 per month, with no setup fee. This plan includes hosting, domain and maintenance, so the R899 monthly fee does not apply on top. You pay before work begins, which covers your first month. Monthly billing starts from the day of launch.
  • Grow: from R7,500 per month, as set out in your Order.
  • VAT: we are not currently registered for VAT, so no VAT is charged. If this changes, we will tell you in writing before VAT applies.
  • All prices are in South African Rand. Payments are accepted through Paystack. Invoices are due as stated on the invoice. Late payment may lead to suspension under clause 13.
  • We may change our prices on 30 days' written notice. Price changes do not affect amounts you have already paid.

4. Usage costs billed separately

Some services depend on usage: calls, phone number rental, SMS and email sending. These are billed at cost, with no markup, and invoiced monthly. Any figures we give you are estimates only, and your actual usage may be higher or lower. Advertising budgets and email platform charges are separate unless they are included in your Order.

5. Term, cancellation and what happens next

  • Respond to Leads: you may cancel at any time by giving us 30 days' written notice. You pay for the notice period, and we do not refund partial months.
  • Get Found: the once-off fee is not refundable once work has started. You may cancel the monthly service on 30 days' written notice.
  • Grow: as set out in your Order.
  • When your plan ends: your website and the systems we run for you (including your inbox, automations, business email and business phone number on our platform) are switched off at the end of the notice period. On request within 14 days of cancellation, we will give you a copy of your enquiry and contact data. Buy-out option: instead of everything being switched off, you may buy out your website for R2,499. We will then give you your website source code and files. You will lose access to website hosting, SSL and every automation attached to the website, such as email notifications when someone completes your quote request form.
  • Cancelling does not cancel amounts that are already due.

6. Domains, hosting and ownership

  • Your own domain: if you bring a domain you already own, it stays registered in your name and you keep it if you leave. We will need access to point it at your website.
  • A domain we register for you: you keep the domain name after you cancel. From then on you manage renewals yourself, and you lose access to every automation attached to our subscriptions.
  • Your website: the website design, code, templates and software we use remain ours or our licensors'. We grant you a non-exclusive licence to use them for as long as your plan is active. If you cancel and want to keep your website, you can buy out the source code and files for R2,499 (see clause 5).
  • Your content: you keep ownership of your logos, text, photos and other material. You give us permission to use it to provide the services.

7. Your responsibilities

You agree to:

  • give us accurate content and information, and tell us promptly about changes;
  • make sure you have the right to use everything you give us (for example photos, logos and text);
  • use our services lawfully, and not send unlawful, misleading or abusive content;
  • get any consent required before we send SMS or email messages on your behalf (for example marketing to existing customers), and honour opt-out requests. South African law, including POPIA and the Consumer Protection Act, restricts unsolicited marketing;
  • request reviews honestly and follow Google's review policies. We do not guarantee any number or rating of reviews, and you must not offer rewards for reviews or ask only happy customers;
  • tell your customers, where the law requires, if calls, messages or enquiries are logged or recorded.

8. Your customers' information and POPIA

When we process personal information about your customers or enquiries (for example names, phone numbers and messages in your inbox), you are the responsible party and we are your operator under the Protection of Personal Information Act 4 of 2013 (POPIA). We will:

  • process that information only to provide the services and on your instructions;
  • keep it confidential and apply reasonable security safeguards;
  • tell you promptly if we become aware of a security compromise affecting it;
  • use sub-processors (such as our platform and messaging providers) under appropriate terms.

You are responsible for having a lawful basis for collecting and using that information and for giving your customers any notices required. Our own use of personal information is described in our Privacy Policy.

9. Third-party platforms

Our services rely on third parties such as our website and CRM platform, Google, telephone and SMS carriers, and email providers. We do not control them. Outages, policy changes, price changes and message delivery problems on their side are outside our control, and we do not guarantee that every call, SMS or email will be delivered. WhatsApp buttons on your website open a chat in your own WhatsApp account. We do not access or manage your WhatsApp conversations.

10. Support and availability

We work to keep your website and systems available, but we do not promise uninterrupted service. We may carry out maintenance that causes short interruptions. Support is available Monday to Friday, 08:00 to 17:00 SAST, excluding public holidays. On Respond to Leads and Grow we aim to respond within 24 business hours. On Get Found we aim to respond within 72 business hours. Website updates beyond your plan are quoted before we start.

11. No guarantee of results

We build and run tools that help you get found and respond to enquiries. We cannot guarantee search rankings, a number of enquiries, reviews, sales or revenue. Local SEO takes time and depends on many factors outside our control.

12. Intellectual property

Except as stated in clause 6, each party keeps its own intellectual property. You may not copy, resell or reverse-engineer our templates, systems or software. We may show your website and results as examples of our work, unless you object.

13. Suspension and termination by us

We may suspend or end your services if you do not pay on time, break these Terms, or use the services unlawfully or in a way that puts our platform or other clients at risk. Where reasonable, we will give you notice and a chance to fix the problem first.

14. Limits on our liability

To the extent the law allows:

  • we are not liable for indirect or consequential loss, including lost profit, lost business or lost data;
  • our total liability to you for any claim is limited to the amount of the last payment you made to us before the event that gave rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded. If you are a consumer under the Consumer Protection Act 68 of 2008 (which can include small businesses below the Act's thresholds), nothing here limits your rights under that Act.

15. Indemnity

You indemnify us against claims, losses and costs arising from content you give us, your unlawful use of the services, or messages sent on your behalf without the consent the law requires.

16. Changes to these Terms

We may update these Terms. We will tell you about material changes by email or on our website at least 30 days before they take effect. If you keep using the services after that date, you accept the updated Terms.

17. General

  • Governing law: these Terms are governed by the laws of the Republic of South Africa, and any dispute will be heard by a court with jurisdiction over it. We will first try to resolve any dispute in good faith.
  • Entire agreement: these Terms and your Order are the whole agreement between us.
  • Notices: written notices may be sent by email to the addresses each party gives the other.
  • If part is unenforceable: the rest of these Terms continues to apply.
  • No waiver: if we do not enforce a right immediately, we do not lose it.
